Allgemeine Maklergeschäftsbedingungen
 
§ 1 Provisionsanspruch

(1) Die Firma Immobilien Huber – Herr Alfred Huber (nachfolgend „Makler“ genannt) erhält für die Vermittlung von Vertragsgelegenheiten eine Provision in nachstehend aufgeführter Höhe zzgl. jeweils gültiger gesetzlicher Mehrwertsteuer (zurzeit 19%):

a) bei Kaufverträgen oder wirtschaftlich ähnlichen Geschäften 3,57% vom Kaufpreis [Hinweis: Üblich sind zurzeit 5-6% vom Kaufpreis inkl. Mehrwertsteuer],

b) bei Vermietung, Verpachtung, Leasing oder wirtschaftlich ähnlichen Geschäften zwei Monatsmieten.

(2) Die vorstehenden Provisionssätze sind mangels abweichender Vereinbarung vom Objektabnehmer an den Makler zu zahlen. Sie gelten, soweit in dem jeweiligen Angebot nicht ausdrücklich eine andere Provision ausgewiesen ist.

§ 2 Fälligkeit der Provision

(1) Mit Abschluss des Hauptvertrages ist die Provision verdient. Sie ist dann auch zur Zahlung fällig.

(2) Bei Zahlungsverzug der Provision oder eines Aufwendungsersatzes sind vom Auftraggeber Verzugszinsen in Höhe von 3% über dem jeweiligen Basiszinssatz, mindestens jedoch 6% zu zahlen. Dem Auftraggeber bleibt der Nachweis vorbehalten, dass ein Schaden nicht oder nicht in dieser Höhe entstanden ist.

§ 3 Mehrfachtätigkeit

Der Makler darf auch für den anderen Vertragsteil provisionspflichtig tätig werden.

§ 4 Weitergabe von Informationen

Die Weitergabe der durch den Makler erteilten Informationen - insbesondere des Nachweises - an Dritte durch den Auftraggeber ist nur nach schriftlicher Zustimmung durch den Makler gestattet. Andernfalls haftet er - unbeschadet eines weiteren Schadensersatzanspruchs - im Falle des Vertragsschlusses durch den Dritten auf die entgangene Provision.

§ 5 Kenntnis von Angeboten

Ist dem Auftraggeber ein Angebot bereits bekannt, hat er dies unverzüglich, spätestens aber innerhalb einer Woche nach Erhalt, schriftlich unter Angabe der Quelle anzuzeigen. Verstöße gegen diese Verpflichtung begründen einen Schadensersatzanspruch des Maklers.

§ 6 Informationspflicht

Der Auftraggeber ist verpflichtet, den Makler unverzüglich schriftlich zu informieren, falls er von seinen Vertragsabsichten Abstand nimmt.

§ 7 Abschluss des Hauptvertrages

Der Auftraggeber ist verpflichtet, den Makler unverzüglich schriftlich über den Abschluss eines Hauptvertrages zu informieren und eine Vertragsabschrift zu übersenden.

§ 8 Haftungsbeschränkung

(1) Der Verkäufer schließt die Haftung für leicht fahrlässige Pflichtverletzungen aus, sofern diese keine vertragswesentlichen Pflichten, Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit oder Garantienbetreffen oder Ansprüche nach dem Produkthaftungsgesetz berührt sind. Gleiches gilt für Pflichtverletzungen unserer Erfüllungsgehilfen und unserer gesetzlichen Vertreter.

(2) Der Makler übernimmt keinerlei Haftung für Angaben in Exposés, Prospekten, Beschreibungen u.Ä., da sie ausschließlich vom Objektanbieter erteilt wurden.

§ 9 Kündigung

Kündigungen des Maklervertrages bedürfen der Schriftform.

Cancellation policy
Users have the following legal right of revocation:

You can revoke your contractual declaration in written form (e.g. letter, fax, email) within 14 days without providing a reason. This period beings after receipt of these instructions in written form, but not before the contract has been concluded and also not before our information obligations have been fulfilled in accordance with Article 246 § 2 in connection with § 1 para. 1 and 2 EGBGB as well as our duties in accordance with § 312e para. 1 sentence 1 BGB in connection with article 246 § 3 EGBGB. The timely dispatch of the notice of revocation shall be deemed sufficient for compliance with the revocation period.

Consequences of Revocation

In the case of an effective revocation, the services received by both sides must be returned and any benefits received (e.g. interest) reimbursed. If it is not possible to return the service provided in part or in full or if it can only be returned in a deteriorated condition, then it is possible that you will have to provide compensation for loss of value. This could mean that you will have to fulfill the contractual payment obligations for the time period leading up to the revocation. Obligations for reimbursing payments must be fulfilled within 30 days. The period begins for you upon dispatch of the notice of revocation and for us upon receipt of the same.
Special note:

Your right of revocation will expire prematurely if the contract has been executed in full by both parties at your explicit request prior to your exercising your right of revocation.
